Information Requested

Labor Unions and Executive Orders FOIA

  1. All documents that refer to, reflect, or mention communications received from a Labor Union Organization or that constitute documents received from a Labor Union Organization relating to any proposal, suggestion, or request for an executive order to be issued by the President.
  2. All documents reflecting any meeting, phone call, e-mail, letter, or other communication between any employee of the federal government and any person or entity outside the federal government regarding the issuance of the below-listed executive orders, or any draft thereof, or the subject matter of the below-listed executive orders:
    • (a) Executive Order 13496, titled “Notification of Employee Rights Under Federal Labor Laws” as published in the Federal Register at 74 Fed. Reg. 6107.
    • (b) Executive Order 13502, titled “Use of Project Labor Agreements for Federal Construction Projects” as published in the Federal Register at 74 Fed. Reg. 6985.
    • (c) Executive Order 13509, titled “Establishing a White House Council on Automotive Communities and Workers” as published in the Federal Register at 74 Fed. Reg. 30903.
    • (d) Executive Order 13522, titled “Creating Labor-Management Forums to Improve Delivery of Government Services” as published in the Federal Register at 74 Fed. Reg. 66203.

Federal Preemption FOIA

  1. All documents that refer to, reflect, or mention communications received from an Advocacy Organization or that constitute documents received from an Advocacy organization relating to federal preemption of tort law.
  2. All documents that refer to, reflect, or mention communications received from an Advocacy Organization relating to any proposal, suggestion, or request for executive order to be issued by the President.
  3. All documents reflecting any meeting, phone call, e-mail, letter, or other communication between any employee of the federal government and any person or entity outside the federal government regarding the issuance of the Presidential Memorandum titled “Preemption” that was published in the Federal Register at 74 Fed.Reg. 24693, or any draft thereof, or the subject matter of that Presidential Memorandum.

For purposes of these three requests, the term Advocacy Organization is meant to include any of the following organizations: (a) American Association for Justice, (b) Public Citizen, (c) Alliance for Justice, (d) Center for Progressive Reform, (e) U.S. Public Interest Research Group, (f) Progressive States Network, (g) Constitutional Accountability Center, and/or (g) Consumers Union. It also includes any official, employee, or known agent of any such organization.
